Terms & Conditions These terms and conditions shall remain in affect for as long as  your shop is at A-Wedding Day specialty bridal mall. Your shop is your web page(s) that are part of the domain www.a-weddingday.com You are not an employee of A-Wedding Day. You are the owner of your own business, a renter of a shop front at A-wedding Day specialty bridal mall located at www.a-weddingday.com/ This is your business and you are responsible to comply with all the laws, ordinances, rules and regulations governing setting up a business where you live. It is your responsibility to register a business name, and acquire all required permits and licenses. Your request to own and operate a shop at A-Wedding Day specialty bridal mall indicates that  You agree to the terms and conditions specified within this agreement, as follows: General Terms and Conditions 1.       A-Wedding Day grants you a license to open a shop at our specialty bridal mall, subject to the conditions as specified in this agreement. Only unique, hand crafted, one-of-a-kind and/or personalized bridal gifts and accessories are to be displayed  at A-Wedding Day specialty bridal mall on its web site on the Internet, and may not violate any copyright, Trademark or patent rights.  2.       Agreement periods are for 12 months.   Service cancellations are permitted within the agreement period with 30 Days advanced notice. Pro-rated refunds of web page hosting fees shall be given at the discretion of A-Wedding Day. A $150.00 NON-REFUNDABLE initial set up charge applies on all cancellations.. 3.       Termination may result if you fail to respond to customer orders satisfactorily, do not fill customer orders promptly, do not respond to inquiries from A-Wedding Day or if the agreement is not renewed within 10 Days of renewal due date. A-Wedding Day will issue NO REFUND for terminations. 4.       Termination may also result if in A-Wedding Day's sole determination you have not complied with any of the terms and conditions within this agreement. A-Wedding Day has the final determination on the acceptability of any product and it’s location on the web site.  A Wedding Day will issue NO REFUND for a terminations. 5.       A-Wedding Day and its owners do not tolerate nor condone spam!!!  We do not allow spamming by shop owners or a link to anyone using spam tactics. Using A-Wedding Day or http://www.a-weddingday.com/  in any spam will result in immediate termination. A-Wedding Day will issue NO REFUND for terminations. 6.       If you already have a site to sell your creations, You will be granted a hyperlink from your shop at the mall, only if your site is family friendly, child safe, and contains absolutely no offensive, controversial, or un-lawful aspects. 7.       A-Wedding Day agrees to create and host web pages/ a shop, at our specialty bridal mall, to display and promote your products. 8.       A-Wedding Day will develop a shop for you, to be used and occupied solely by you for the exclusive purpose of displaying your unique, hand crafted, one-of-a-kind and/or personalized bridal gifts, accessories and services. A-Wedding Day will jury all applications and retain the right to accept or reject any crafter or artisan pending the jurors' decision. A-Wedding Day further reserves the rights to censor, re-classify, revise, edit, or remove shop or link that does not meet our standards. 9.       You agree to provide A-Wedding Day with photos, descriptions, prices, color, size etc… to post on your web page(s).  Only those photos deemed appropriate by A-Wedding Day will be posted. 10.   A-Wedding Day reserves the right to select the photos that best represent the products offered. Additionally, A-Wedding Day reserves the right to refuse photos that are considered inappropriate. 11.   A-Wedding Day will own the copyrights for creative design and development of the web pages created for you. 12.   You maintain the copyrights to images and graphics you provide that are used to build your shop. 13.   A-Wedding Day agrees to maintain its web site mall on a continuous basis but will not be liable for problems associated with the World Wide Web, electronic failures, telephone line interruption, and the like. Should such events occur, You will NOT be compensated. 14.   Photo exchanges and/or additions, as well as changes in description, may be made to the existing web page(s) at any time during the agreement period.  Your request for changes will result in a set up fee and your request for additions will result in an additional hosting fee.  15.   You may, in fact are encouraged, to promote your shop at A-Wedding Day, including  but not limited to linking to other sites on the Internet. However, we do not tolerate spamming and doing so may result in termination. DO NOT SPAM!!! 16.   You may, in fact are encouraged, to introduce other crafters and artisans to opening shops at A-Wedding Day mall. When a crafter or artisan, you referred, opens a shop at the mall, you receive CREDIT POINTS. These credit points may be exchanged for services as agreed upon by A-Wedding Day during a promotion. 17.   You set the prices for your products. 18.   If you sell out of your shop at A-Wedding Day mall, you are responsible for contacting the customer, shipping the order, and payments of all taxes and tariffs. 19.   In the event that a product must be returned due to dissatisfaction, defect, or misrepresentation of the product, you are responsible to refund or replace the product.  Failure to do so may result in termination. 20.   A-Wedding Day and its owners will not be responsible, nor held liable for any warranty, guarantee, offers, claims or promises you make to your customers. You must handle any dispute between you and your customers directly, whether they ordered from your shop at A-Wedding Day or by other means. You further agree to hold A-Wedding Day and its owners harmless from all claims. 21.   A-Wedding Day is not responsible for any part of the order procedure which includes, but it not limited to: shipping charges, returns, damages, exchanges, customer checks that bounce, fraudulent credit card information and any other claim that a customer may have. 22.   In the event that a customer’s purchase(s) are lost or damaged in transit, it is your responsibility to present damage claims to the Courier Company used to ship the parcel.  You agree to ship the customer a duplicate or like product in exchange for the lost or damaged product and to deal directly with the Courier Company that shipped the parcel for reimbursement.  23.   A-Wedding Day and its owners will not be held liable for reimbursing you for shipping charges on the replacement product. 24.   A-Wedding Day and its owners will not be liable to you or any other person for any damage to persons or property caused by your acts, omission, or negligence by you or any user of your products. 25.   You agree to indemnify, defend, and hold A-Wedding Day and its owners harmless from any and all claims for any such damages including negligence and product liability. 26.   Your rights under this Agreement and Contract are personal to you and are not transferable without written consent of A-Wedding Day. 27.   A-Wedding Day may sell, assign, pledge, or otherwise transfer its rights under this agreement with 30 Days notice to you. 28.   It is agreed that this Agreement shall be governed by, construed and enforced in accordance with the laws of the State of California. 29.   A-Wedding Day reserves the right to modify, amend, and completely revoke, establish and change any general rules from time to time as it deems necessary.  You will be noticed of any such change. 30.   Upon execution of this agreement, you will pay A-Wedding Day the sum as per schedule.  Unless this agreement is terminated by you in writing 30 Days prior to the end of term, A-Wedding Day will charge you the same amount as indicated in this agreement package, less any CREDIT POINTS you accumulated. Disclaimer Each user or shopper is solely responsible and agrees that when using A-wedding day bridal mall it will deal directly with each independent business for any warranty, guarantee, refund, or any other offers, claims, or promises made by the independent business. Users or shoppers will hold the independent businesses responsible for any orders, products, or services rendered by the independent business. Furthermore A-wedding day will not be liable for any direct, incidental, consequential, indirect or punitive damages due to your use or inability to use the A-wedding day site. Neither A-wedding day nor its owners endorse any company, organization, product or service advertised on this domain at www.A-weddingday.com Any product or service advertised here, aside from our own, are the sole responsibility of the advertiser, not A-wedding day, nor its owners. A-wedding day, will not knowingly accept promotional material from businesses or individuals who sell, promote, or advertise materials that are not totally family friendly and children safe. We cannot verify the validity or accuracy of every web site, advertisement, billboard info or any message. We reserve the right to censor, re-classify, revise, edit, discontinue hosting or reject any advertisement or web site not meeting our standards for acceptance. A-wedding day is not responsible for errors or omissions or for the integrity of the Crafters and artisans listed or the quality of the product offered. All Crafters and artisans are responsible for obtaining proper copyrights permissions. Should they fail to do so, A-wedding day takes no responsibility for their action. A-wedding day does not allow spamming by store owners or links. Anyone using A-wedding day or a-weddingday.com in any spam, faces removal without notice and loss of any money paid for service. A wedding day will not refund any money for any accounts removed for any reason after 30 days. A-wedding day service is provided "as is" without warranty of any kind. In no event shall A-wedding day or its owners be liable for any damages whatsoever. The information, merchandise, and materials contained in the site, including, without limitation, text, graphics, and links, are provided on an "as is" basis with no warranty. To the maximum extent permitted by law, A-wedding day and its owners, disclaim all representations and warranties, express or implied, with respect to such information, merchandise, and materials. In no event shall A-wedding day be liable for costs arising out of or in connection with the use, inability to use, or performance of the information, merchandise, and materials available from this site. Our Billing policies All Shop Hosting Fees are due at the time you order your service. A payment plan is available. A $150 down payment is required before your shop is set up.  When it is time to renew  your agreement, please send in your payment on or before the 1st day of the month at the beginning of your renewal period.  A reminder will be sent to you by email prior to that time.  Your payment will be considered late if it has not been received by 5:00 p.m. on the 10th of the month starting with the first month of your 12 month renewal. A late charge of $10 will be applied.  If it has not been received by the 15th day your shop will be suspended and a re-connect charge of $25 will be added to reinstate your shop. You can pay by check, Money order, Visa, Master Card or the Discover card. In order to keep costs down, we do not send invoices.  If you require a hard copy of your  invoice by fax or snail mail, the cost will be an additional $3.00 per invoice in the Continental U.S., or $5.00 elsewhere.  Your canceled check or your credit card statement will serve as your receipt. Checks or Money orders should be made payable to "Gan Publishing". If you are paying by credit card, the charge will appear on your statement as "Gan Publishing".
